Penticton RCMP’s Targeted Enforcement Unit (TEU) executed a search warrant at a high-profile marijuana dispensary, located at 936 Main Street in Okanagan Falls Wednesday afternoon.

The dispensary is believed to be Herbal Green Apothecary, which is owned and operated by Jukka Laurio, who was engaged in a longstanding battle against the City of Penticton for running a marijuana dispensary

Laurio agreed to pay a $15,000 fine in a Kelowna courthouse in early May after he and the City of Penticton reached a settlement agreement.

A male was taken into custody, as a result of officer’s locating several pounds of marijuana and marijuana edibles, said an RCMP news release.

Police did not name the man taken into custody on Wednesday.

This investigation confirmed the dispensary was operating without a license to sell marijuana and that anyone from the general public could purchase the drug without any medical note, said police. The investigation is ongoing.

The City of Penticton announced the first week in May that it had successfully concluded its marijuana dispensary civil injunction in the B.C. Supreme Court case at the Kelowna courthouse.

The city had obtained an injunction against Laurio doing business as Herbal Green Cafe for operating a marijuana dispensary within city limits.

A Kelowna judge ruled that the owner of Herbal Green Cafe, also known as the Russian and Finnish Cafe, was prohibited and restrained from selling, using, storing or possessing marijuana/cannabis in any way at its premises located at 256 and 248 Westminister Avenue in Penticton.

The ruling also states Laurio must comply with five separate city bylaws and two provincial statutes and must also withdraw the judicial proceedings he has filed against the City of Penticton without costs.

Laurio agreed to pay a fine in the amount of $15,000 to the City of Penticton and the failure to do so will result in a doubling of the fine to $30,000.

The fine was believed to be the largest against a marijuana dispensary owner or operator in B.C. history.

The Herbal Creen action was part of the city’s bylaw enforcement department’s prosecution of three dispensaries in Penticton through court orders.

In early January, Laurio announced he was closing his Penticton business and opening up shop in Okanagan Falls.

The Herbal Green Apothecary, located on Main Street in Okanagan Falls, opened in mid-January.

The City of Penticton had decided not to extend temporary use permits to two other marijuana dispensary businesses, but instead asked them to sign consent orders committing them to transform into wellness centres and agreeing not to sell cannabis products.

Owners of Okanagan Cannabinoid Therapy and Green Essence agreed to sign the orders, but Laurio refused.
