On Jan. 16, the City of Kelowna filed a petition to the BC Supreme Court to stop the anti-vaccine protests that have commonly taken place in Stuart Park. 

In the petition, the City names David Lindsay, Jane and John Doe and persons unknown, saying the respondents are violating the bylaws by hosting “events” in the park without written permission. 

The City says the group has been engaging in activities that “create a nuisance and interfere with the use and enjoyment of the park by other persons,” according to the petition. 

In addition, the City says the group of protestors is contravening Kelowna’s Good Neighbour Bylaw. 

The petition is seeking to restrict the group from hosting rallies, events or protests between Recreation Avenue to the Highway, and from Gordon Drive to the lake. 

According to court documents, the City is looking to give the RCMP authority to arrest and remove any person who violates the order.
